The agreement between Bright Berry Education and every family we teach. One document, plain English, and the rules are the same for everyone.
Version 2.2 — effective 11 September 2026. These Terms supersede the Bright Berry Education Client Policy (last revised 04/06/2026), the Client Policy for Holiday Lessons (last revised 03/10/2024) and the Group Classes Terms and General Conditions (last revised 26/08/2026). One document now covers one-to-one tuition, ongoing group classes and holiday/block bookings.
These terms and conditions ("Terms") set out the agreement between Jenny New, trading as Bright Berry Education ("Bright Berry", "we", "us"), of 7 Whitehead Drive, Kenilworth, CV8 2TP, and you, the parent or carer who enrols a child for online tuition ("you"). The child or young person receiving tuition is the "Student". You confirm that you are at least 18 years old and have parental responsibility for the Student (or the authority of someone who does).
These Terms apply to all tuition we arrange — ongoing weekly tuition (one-to-one or in a small group) and pre-paid holiday lessons or block bookings (section 2A). They also incorporate our Safeguarding Statement, our Privacy Policy and the Recording Policy in section 7. Where we say "in writing" we include email and WhatsApp messages to or from the contact details in section 9.
We will send you these Terms (or a link to them here) together with a written enrolment summary setting out the Student's name, subject(s), lesson format (one-to-one or group), lesson frequency and the agreed weekly time slot (or, for a Block Booking, the lesson dates and times), the price per lesson and the start date ("Enrolment Summary"). A binding contract is formed when you confirm your acceptance of the Enrolment Summary and these Terms in writing (a reply email or message saying "I accept" is sufficient), or, if earlier, when you pay your first invoice. We will not schedule a first lesson until we have your written acceptance and the safeguarding and data-protection consents described in section 8. The Enrolment Summary and these Terms together form the whole agreement; if they conflict, the Enrolment Summary takes priority.
We may update these Terms from time to time, for example to reflect changes in the law, our prices or how we deliver lessons. We will give you at least 30 days' written notice of any change that affects you. If you do not wish to accept a change you may end this agreement, without any further charge, by giving us notice before the change takes effect. Continuing with lessons after the change takes effect means you accept the updated Terms. The current version is always published on this page with its revision date.
Because this contract is made at a distance (online, by email or by phone) you have a legal right to cancel it within 14 days of the day the contract is formed, without giving a reason, under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. To cancel, email us at the address in section 9 (you may use the model cancellation form but do not have to). If you have asked us to start lessons within the 14-day period and then cancel, you must pay for any lessons delivered before you cancelled, and we will refund the balance of anything you have paid within 14 days.
We charge monthly in advance. On or around the 25th of each month we will send you an invoice, and take payment, for all lessons scheduled in the following calendar month at the per-lesson price stated in your Enrolment Summary. Your first invoice covers the lessons remaining in your first month (pro-rated if you join mid-month) and must be paid before the first lesson takes place. Prices are in pounds sterling. We are not currently VAT registered; if that changes we will give you notice. Holiday lessons and block bookings are invoiced and paid in full in advance, as set out in section 2A.
Payment is taken by debit or credit card through our payment provider (currently Stripe, via our TutorBird scheduling system). By enrolling you authorise us to take recurring monthly payments from the card you register until this agreement ends. Your card details are held by the payment provider, not by us. If a payment fails we will tell you and try again; if payment is not received within 2 business days of the invoice date we may suspend lessons until it is, and lessons missed because of suspension remain chargeable. We may charge statutory interest on late payments but will not do so without warning you first.
Deposits (group classes): If you enrol for a group class more than six weeks before the Student's first lesson, a £25 deposit (taken as a one-off card payment) secures the place and counts as payment towards the first lesson. If you enrol within six weeks of the first lesson, no deposit is needed — you go straight to card set-up and your pro-rated first invoice. If you cancel within your 14-day cancellation period (section 1) the deposit is refunded in full; after the 14 days it is non-refundable, because the place has been held for the Student.
Schedule: Lessons take place online at the weekly time(s) set out in your Enrolment Summary. Lessons are 60 minutes unless your Enrolment Summary says otherwise.
Getting to Know You session: Before lessons begin we offer a free 15-minute consultation call with Bright Berry, followed by a short "Getting to Know You" session so that we can learn about the Student's specific learning needs and recommend the best tutor for them. There is no obligation to continue after this session.
Reserved time slots: When the Student enrols, a specific weekly lesson time is reserved for them and held exclusively for that Student each week. This is why the cancellation rules below apply.
Late arrivals: If a student arrives late, the lesson will still end at the scheduled time and no adjustment to fees will be made. If the tutor is late, the lesson will be extended to ensure the student receives the full lesson time.
Waiting period: The tutor will wait up to 10 minutes after the scheduled start time for the Student to join. If no contact has been made after 10 minutes the lesson is treated as a missed lesson and is charged in full. If you contact us to say the Student is running late, the tutor will wait up to 30 minutes from the start time where possible, but the lesson will still end at the scheduled time.
Cancellation of one-to-one lessons: Our tutors work to a fixed weekly timetable and the Student's slot cannot usually be offered to anyone else at short notice. If a lesson needs to be cancelled (for example because of illness or a school event) you must tell us in writing at least 48 hours before the scheduled start time. Where 48 hours' notice is given we will issue a make-up credit for that lesson. A make-up credit is valid for one calendar month from the date of the cancelled lesson and can be used for a replacement lesson at a time agreed with us and the tutor, where the tutor has availability; if the tutor is fully booked, a replacement lesson is not available. You may reschedule up to two lessons in any calendar month in this way. If no suitable replacement time can be found within one month the credit expires and the original lesson remains chargeable.
All scheduled lessons remain chargeable, because the tutor has reserved that time and is unlikely to fill it at short notice. A make-up credit is the remedy for a properly cancelled lesson; we do not refund individual lessons.
If less than 48 hours' notice is given, or if the Student does not attend, the lesson is treated as a missed lesson and is charged in full; no make-up credit is issued. We will always use reasonable discretion in genuine emergencies.
Group lessons: Group lessons run to a fixed timetable for the whole group and cannot be cancelled or rescheduled by an individual family; if a session is missed the session fee remains payable in full, and you may request the lesson recording instead (see section 7). If the Student is running late, tell the tutor via their Bright Berry email address — because it is a group session, the lesson continues as scheduled and cannot be held back for a late arrival. Leaving a group class works like ending the agreement: one full calendar month's written notice (section 3), with fees payable for the notice period.
What a block booking is: From time to time we offer lessons outside the ongoing weekly schedule — for example revision courses or intensive lessons in the school holidays — sold as a fixed block of lessons on set dates ("Block Booking"). This section applies to Block Bookings instead of the monthly rules in sections 1 to 3 where they differ; everything else in these Terms applies to Block Bookings in the same way.
Booking and payment: We will send you an Enrolment Summary for the Block Booking setting out the Student, subject, the dates and times of each lesson, the number of lessons, the total price and the package level (see below). A Block Booking is confirmed, and the lesson slots reserved, when you have accepted the Enrolment Summary and these Terms in writing and paid the invoice in full. Block Bookings are invoiced in advance and must be paid before the first lesson; payment may be made by card through our payment provider or by bank transfer where the invoice offers it. Block Bookings are not a subscription: nothing further is charged after the block ends, and no notice is needed to stop.
Your 14-day right to cancel: The 14-day cancellation right in section 1 applies to a Block Booking. If you ask us to start lessons within the 14-day period and then cancel, you pay for the lessons delivered before you cancelled and we refund the rest. Because holiday lessons are often booked at short notice, this will usually mean that lessons already taught are paid for and any remaining lessons in the block are refunded.
Rescheduling within the block: Holiday lesson slots are reserved for the Student and our tutors plan their holiday availability around them, so Block Booking lessons cannot be cancelled for a refund once the 14-day period has passed. If a lesson needs to be moved (for example for illness), tell us in writing at least 48 hours before the lesson and we will do our best to offer another time within the same holiday period, subject to the tutor's availability; we cannot guarantee a replacement slot and, if none can be agreed, the lesson remains chargeable. Lessons cancelled with less than 48 hours' notice, or not attended, are charged in full. Late arrival, early finish, lateness and waiting-time rules in section 2 apply in the same way.
Packages: Block Bookings may be offered at different package levels (for example standard lesson summaries, or detailed notes and additional materials). The package you have chosen, and what it includes, is stated in your Enrolment Summary.
If we cancel: If we have to cancel a Block Booking lesson and cannot offer a replacement within the holiday period, we refund that lesson within 14 days.
Bright Berry operates a year-round tuition model to support consistent academic progress; we do not offer term-time-only contracts. We understand that families need flexibility, and the following structure allows for planned breaks while protecting tutor availability.
Longer breaks: Any longer break must be requested in writing and will be considered case by case. For any absence longer than two weeks we cannot guarantee to hold the Student's regular slot unless you pay a slot-retention fee of 50% of the normal lesson price for the third and each subsequent week of absence. If you choose not to pay the retention fee we will do our best to offer the same or a similar slot when the Student returns, but cannot promise it.
This structure allows our tutors, many of whom teach internationally, to keep stable schedules while ensuring Students benefit from consistent learning.
Ending the agreement (notice by you): You may end this agreement at any time by giving us one full calendar month's notice in writing. Notice given during a month takes effect at the end of the following calendar month, and lessons continue (and are charged) until then. This notice rule does not apply to Block Bookings (section 2A), which simply end when the block ends. For example, notice given on 15 April means the final lesson date is 31 May; notice given on 31 January means the final lesson date is 28 February.
Ending the agreement (notice by us): We may end this agreement by giving you one calendar month's written notice. We may also end it, or suspend lessons, immediately by written notice if: (a) an invoice remains unpaid 14 days after we have reminded you; (b) you or the Student behave in a way that is abusive, discriminatory or threatening towards a tutor or member of our team; (c) you breach the Recording Policy (section 7) or the communication rules (section 4); (d) we reasonably consider that continuing would not be in the Student's or a tutor's best interests, including for safeguarding reasons; or (e) we stop offering tuition in the relevant subject or level. If we end the agreement other than for your breach, we will refund any payment you have made for lessons that will not now take place, within 14 days.
Your statutory rights: Nothing in these Terms affects your legal rights as a consumer. Under the Consumer Rights Act 2015 we must provide our services with reasonable care and skill; if we do not, you can ask us to put it right or, where that is not possible, to reduce the price. For more information contact Citizens Advice.
Lessons are delivered online (currently via Zoom). Please make sure the Student has a working device with camera and microphone, a stable internet connection and a quiet, suitable space, and is familiar with the platform before the first lesson. A laptop or PC is best (a tablet is fine with a little initial support), and the Student should have a pen or pencil and lined paper to hand — the tutor may ask the Student to show their work on camera, or ask you to photograph work after the lesson so it can be reviewed. The lesson joining link is sent once your first invoice has been paid.
If there is a connection problem, the Student should use the platform chat or you should contact us on the details in section 9. We cannot refund or credit lessons lost to problems with your own device or internet connection. If the problem is on our or the tutor's side, we will either extend the lesson, reschedule it or issue a make-up credit at no cost to you.
All communication between families and tutors must take place either during the lesson itself or through the tutor's dedicated Bright Berry email address, which we give you at enrolment. This is the only approved channel for tutor–parent communication outside lessons. Please do not contact tutors on personal email addresses, mobile numbers or social media, and do not accept an invitation from a tutor to do so — if this happens, please tell us straight away. Tutors are instructed never to contact a Student directly outside scheduled lessons. These rules exist so that all communication is properly supported, safeguarded and logged by Bright Berry. For the same reason, you agree not to engage any tutor introduced to you by Bright Berry for private tuition outside Bright Berry, during this agreement and for 12 months after it ends.
After each one-to-one lesson we aim to send you a lesson summary (or, where your Enrolment Summary includes a package with detailed notes, those notes), within 24 hours, by email or through TutorBird. For group lessons you may request access to the lesson recording.
Homework is set after each lesson where the tutor considers it useful, or on request. Homework in one-to-one lessons is marked during the next lesson with the Student — the most effective way for students to receive feedback. For group classes, whole-class feedback is shared with the group at the start of the next lesson.
Our 12-week progress promise: We are confident that every Student who attends regularly will make measurable progress. If, after 12 weeks of lessons, the Student has not made measurable progress against the starting point recorded at the Getting to Know You session, we will review the plan with you and, if you wish, refund the lesson fees you have paid for those 12 weeks. To qualify, the Student must have attended at least 90% of scheduled lessons in the period and completed the homework set, and you must tell us within 14 days of the end of the 12-week period. Progress is assessed by Bright Berry using the same assessment used at the start. We cannot guarantee specific exam grades.
If a tutor is unavailable (for holiday, illness or otherwise) we will tell you as soon as we can. Where possible we will offer a suitably qualified substitute tutor for the affected lessons; if you would rather wait for the regular tutor, or no substitute is available, the lesson will not be charged (or a make-up credit will be issued). We may change the Student's regular tutor if a tutor leaves Bright Berry or if we consider a different tutor would better suit the Student; we will discuss this with you first wherever practicable.
Lesson recording: All lessons are recorded (video and audio). We record lessons for two reasons: to safeguard Students and tutors by allowing lessons to be reviewed, and to monitor and improve teaching quality. Group-lesson recordings are also made available to families who miss a lesson. By enrolling you consent, on your own behalf and on behalf of the Student, to lessons being recorded on this basis, and you agree to explain this to the Student. If you withdraw consent to recording we will not be able to continue lessons, because recording is a core safeguarding control.
How we use your information: Jenny New trading as Bright Berry Education is the "controller" of the personal information we hold about you and the Student. We use it to provide and manage tuition (the legal basis is performance of our contract with you), to keep children safe (legal obligation and legitimate interests), and, with your consent, to record lessons. Our full Privacy Policy explains what we collect, how long we keep it, who we share it with and your rights.
Information about the Student: We will ask you for information about the Student's learning needs and, where relevant, special educational needs, health or wellbeing so that tutors can teach effectively. We only collect what we need, we keep it in a restricted area and we share it with the Student's tutor on a need-to-know basis. By providing it you consent to our using it for these purposes.
Storage and retention: Recordings are stored securely with access limited to Bright Berry and the Student's tutor, and are deleted 30 days after the lesson unless we need to keep a recording for a safeguarding or complaint reason, in which case we will keep it only for as long as that reason requires.
Security: Recordings and personal information are stored on encrypted, access-controlled services. Everyone who handles Student data for Bright Berry is briefed on data protection and confidentiality.
Your rights: You (and, depending on age and understanding, the Student) have the right to ask for a copy of the personal information we hold, to have it corrected or deleted, to object to or restrict certain processing and to withdraw consent. To exercise these rights contact us using the details in section 9. You can also complain to the Information Commissioner's Office (ico.org.uk).
Data breaches: If a personal-data breach occurs that is likely to affect you or the Student we will tell you without undue delay and will notify the Information Commissioner's Office within 72 hours where required by law.
Access to recordings: Group-lesson recordings are available on request to families whose Student missed the lesson; email us and we will normally send a link within one working day. One-to-one recordings are kept for safeguarding and quality purposes and are not routinely shared, but you may ask to view one.
No sharing: Recordings are for the enrolled Student and their family only. They must not be downloaded, copied, shared with anyone else, or posted on social media or elsewhere online, because they contain images and voices of other children and of tutors. Doing so is a serious breach of these Terms and may lead to immediate termination of the Student's lessons.
Other children's privacy: In group lessons other Students will be visible and audible. You and the Student must not capture screenshots, photographs or recordings of lessons or of other participants.
Deletion: Recordings are held on a secure server and deleted after the retention period above.
Safeguarding: The safety and wellbeing of Students is our first priority. Our Safeguarding Statement explains what we do to keep Students safe — including enhanced DBS checks for every tutor, lesson recording, safeguarding training and a named Designated Safeguarding Lead — and what we ask of you. Before the first lesson we will ask you to confirm in writing that you have read it and consent to the safeguarding and data-protection arrangements it describes. If a tutor has a concern about a Student's safety or welfare we will follow our safeguarding procedure, which may include sharing information with the local authority or police without first telling you, where we believe a child is at risk.
Supervision at home: Lessons take place in the Student's home (or another place you choose). You are responsible for the Student's supervision and safety during lessons, including choosing a suitable, appropriately private but not isolated space. A parent or carer should be contactable for the duration of each lesson.
Behaviour: We expect Students and tutors to treat each other with courtesy. A tutor may end a lesson early if a Student's behaviour makes it impossible to continue, and the lesson will remain chargeable; we will always discuss this with you afterwards.
Daylight savings adjustments: Tutor session times change with British Summer Time. Exceptions may be arranged on request, depending on tutor availability.
Dress and environment: Students (and tutors) must be appropriately dressed during online lessons and lessons should take place in a suitable room, not a bedroom where this can be avoided. A tutor may end a lesson if these expectations are not met.
Outcomes: We know that every Student who works with Bright Berry can make significant gains, and our tutors will work diligently to support each Student's learning. However, exam results depend on many factors outside our control and we cannot guarantee specific exam outcomes or grades (see also our 12-week progress promise in section 5).
Our liability: We do not exclude or limit our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow us to exclude. Otherwise, we are not liable for losses that were not foreseeable when the contract was made, for business losses, or for the Student's exam results, and our total liability to you in connection with this agreement is limited to the fees you have paid us in the 3 months before the event giving rise to the claim. Tutors are self-employed professionals engaged by Bright Berry; Bright Berry remains responsible to you for the tuition service under these Terms.
Teaching materials: Worksheets, recordings and other materials we or our tutors provide are for the Student's personal study only and may not be copied, shared or used commercially.
Complaints: If something goes wrong please tell us as soon as possible, by email to the address in section 9. We will acknowledge a complaint within 2 working days and aim to give you a full response within 14 days. The Parent Promise on our website explains the remedies we offer if you are not happy.
General: This agreement is personal to you and cannot be transferred. If any part of these Terms is found to be unenforceable the rest continues to apply. These Terms are governed by the law of England and Wales and any dispute can be brought in the courts of England and Wales (or, if you live in Scotland or Northern Ireland, the courts there).
